This page assists landlords in ensuring that they know what is required of them to rent out a property and also during the tenancy.

Electrical Safety Standards


On 1 June 2020 the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 came into force. The regulations mean that landlords have a legal duty to have all electrical installations within a rented property inspected and tested by a competent person at least every 5 years.

 

These regulations apply to all new specified tenancies from 1st July 2020, and existing specified tenancies from 1st April 2021.

Following the inspection and testing, the landlord must:

  • Obtain a report from the person conducting the inspection and test.
  • Supply a copy of that report to each existing tenant within 28 days.
  • Supply a copy of that report to the local housing authority within 7 days of receiving a request in writing for it from that authority.
  • Retain a copy of that report until the next inspection and test is due and supply a copy to the person carrying out the next test and inspection.
  • Supply a copy of the most recent report to any new tenant before they occupy the premises, and to any prospective tenant within 28 days of receiving a request in writing for it from that prospective tenant.

Where further investigation or remedial work are required by the report this must be carried out within the time specified by the report and within 28 days from the date of the test.

For houses of multiple occupation (HMO’s), there is an existing legal requirement to obtain an electrical installation test every five years. Current provisions in Regulation 6(3) of the Management of Houses in Multiple Occupation (England) Regulations 2006 have been repealed, ensuring all properties are in scope of the new Regulations. These Regulations require a new mandatory condition on electrical safety to be placed on HMO licences. This condition will apply to all licences granted after 1 June 2020.  

If we believe that the landlord is in breach of the requirements, we have a duty to serve a remedial notice under the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020. If the remedial notice is ignored and action is not taken within 28 days, we can arrange for the remedial works to be carried out, with consent from the tenant, and recover the costs from the landlord. We can also impose financial penalties of up to £30,000.

Minimum Energy Efficiency Standard (MEES)

 

Since April 2018, new tenancies in England and Wales have had to meet the Government's minimum energy efficiency standard (MEES). Properties which require an energy performance certificate (EPC) must reach a minimum ‘E' rating on their EPC assessment, or have a valid exemption registered.

 

The Government has introduced a ‘cost cap', requiring landlords to spend up to £3,500 per property to improve them to the minimum level. If you cannot improve your property to EPC E for £3,500 or less, you should make all the improvements which can be made up to that amount, then register an ‘all improvements made’ exemption.

 

From 1 April 2020, this requirement has extended to all existing tenancies.

 

If a local authority believes a landlord has failed to fulfil their obligations under the MEES Regulations, they can serve the landlord with a compliance notice. If a breach is confirmed, the landlord may receive a financial penalty.

Landlord Gas Certificates

As a landlord, you are responsible for the gas safety of your tenants. You must ensure that all gas appliances are working correctly and safely. Therefore, every rental property that has any sort of gas appliance, whether it be a gas boiler, hob, oven or fire, requires a Gas Safety Certificate. Fees


Our management is taken as a percentage of the gross rents paid by the tenant for the duration of the tenancy.

 

Management Fees are from 5%+VAT depending on the detailed service that you need. This can range from rent collection only to monthly, quarterly, six monthly inspections.

 

Some of our landlords like to sit back and let their Letting Agent deal with everything from paying service charge, ground rent, insurance to dealing with HMRC Tax reporting, dealing with accountants and this is why our fees start at 5%+VAT.
